Terms of service

These terms set out the agreement between you and BrandKind when you use the service. Please read them; by using BrandKind you agree to them.
Agreement
This agreement is between BrandKind and the person or organisation that holds the account: the customer. By creating an account or using the service, you accept these terms. If you are agreeing on behalf of an organisation, you confirm that you are authorised to bind it.
The service
BrandKind is a content studio. You paste or write text, choose a "voice", and the service rewrites it in that style and formats it for the channels you need, whether that is a website, a newsletter, social posts or a press release, ready to copy and use. The rewriting is done by AI, through the provider chain described in our privacy policy.
Your account & responsibilities
You are responsible for keeping your login details secure and for what happens under your account. Give us accurate details when you sign up, and keep them up to date. Tell us promptly if you think someone else has gained access to your account. You are also responsible for the content you submit, including having the right to use it.
Acceptable use
Use BrandKind lawfully. Do not submit content that is unlawful, that infringes someone else's rights, or that you have no right to use. Do not use the service to break the law, to mislead people in ways the law forbids, or to harass or harm anyone. We may suspend or close an account that breaches these terms.
Ownership of your content
You own what you create
Our intellectual property
The BrandKind platform, including its software, design and brand, remains the property of RoodtSquared Ltd and its licensors. Using the service gives you a limited, non-exclusive right to use it while your account is active. It does not transfer any ownership of the platform itself to you.
AI-generated output
BrandKind's output is generated by AI. It can be wrong, out of date, or not quite what you meant, so treat it as a strong first draft rather than a finished, checked piece. You are responsible for reading it and deciding whether to publish it. We do not guarantee that the output is accurate or fit for a particular purpose.
That is the deal BrandKind is built around: it gives you brand-shaped content quickly, and you stay the person who checks it and signs it off. It is not a machine that publishes for you.
AI detection: what we don't promise
No guarantee of passing an AI detector
AI-detection tools are third-party products we neither control nor have any relationship with. They do not agree with one another: the same piece can read as human to one tool and as AI to another on the same day. They change constantly, retraining as new AI models appear, so a result today is not a result next month. And they get it wrong in both directions, including flagging writing that a person wrote unaided. The organisations that build these tools say so themselves — their own guidance is that a detection score is a signal to look more closely, not a verdict, and should not be the sole basis for a decision about someone.
BrandKind does show you a score of its own. That score is one detection tool's reading of your text at one moment in time. It is there to help you judge your draft, and we do not present it as a prediction of what any other tool will say, a pass certificate, or a promise about any outcome that depends on someone else's check.
Where you are subject to rules about disclosing AI assistance — an academic body, a professional regulator, a client contract, a publisher's policy — meeting those rules is your responsibility. Using BrandKind is not a way around them, and we do not support using it for that.
Search-engine results
We do not guarantee any particular search-engine outcome from content produced with BrandKind: not a ranking, not traffic, not visibility, not indexing, and not any effect on an existing position. Search engines run ranking systems they control and change without notice, and results depend on your website, your market, your competitors and much else outside the text itself. Anything we say about search is a general view, not a forecast and not a commitment.
Credits & what they pay for
Paid use of BrandKind runs on credits. Your plan grants an allowance of credits, and specific actions spend them. The actions that cost credits are generating content, humanising a piece, generating an image, running an AI-detection check, and pushing a piece to a connected destination. The price of each is shown in the app before you run it, and the balance in your workspace is the authority on what you have left.
Editing is always free
A run that fails is refunded automatically. If a generation errors or does not complete, the credits it took go back to your balance without you asking. Choosing to run something again because you would like a different result is a new run and costs a credit; that is the case whether the first result was disappointing or simply not what you were after.
Credits granted to your workspace have an expiry, and your plan sets it. Where your plan does not include rollover, an allowance covers one billing period and unused credits lapse at the end of it. Where your plan does include rollover, unused credits stay available for the number of months your plan states and then lapse. Credits are always spent oldest-first, so the ones closest to expiring are used before newer ones. Lapsed credits are gone and are not restored. Credits are not money: they have no cash value, cannot be exchanged for cash, and cannot be transferred to another workspace. [CONFIRM: what happens to a credit balance when a subscription is cancelled mid-cycle — are remaining credits usable until the period ends, or forfeited at cancellation? Not yet decided; do not state a position until it is.]
Support
Reporting a fault is included with your subscription. If something in BrandKind is broken, you can raise it with us and we will look at it, and we log it so it is tracked rather than lost. That is the support that comes with the service.
Real-time, first-line support — help by phone or email while you work, questions about how to use the service, assistance with your own content or your own systems — is not included. It is a separate, chargeable service. If you need it, contact us and we will quote for it. [CONFIRM: response-time commitments, the channels included with a bug report, and the price of the paid first-line support tier are not yet agreed — see roodtsquared#23. Do not publish response times until they are set, because a published one is a promise.]
Your data
What we do with your account details and the content you submit is set out in full in our privacy policy, which forms part of these terms. In summary: your account and the content you save are stored in the United Kingdom and stay there at rest; some processing takes place outside the UK, including in the United States, under the transfer safeguards UK GDPR requires; and neither we nor the AI providers we use train models on your content. Customers who need a data-processing agreement, or the named list of our sub-processors, can request both from us.
Availability & changes
We provide the service with reasonable care but on an "as is" basis: we do not promise it will always be available or free of faults. We may change, add to, or remove features as the product develops, and we may update these terms. If we make a material change to these terms, we will update this page and, where it affects you, let account holders know.
Liability
Nothing in these terms limits any liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you for any claim arising from these terms or your use of the service is capped at the fees you paid us in the 12 months before the claim arose, and we exclude liability for indirect or consequential loss, such as loss of profits or loss of data.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
